Pour des raisons qui lui sont propres, un salari\u00e9 peut librement solliciter un cong\u00e9 sans solde, aussi appel\u00e9 cong\u00e9 pour convenances personnelles. Il peut s\u2019agir par exemple d\u2019une journ\u00e9e d\u2019absence pour accompagner son enfant lors de la rentr\u00e9e des classes ou bien d\u2019un cong\u00e9 d\u2019une plus longue dur\u00e9e pour se consacrer \u00e0 une activit\u00e9 de son choix.<\/p>\n

Le cong\u00e9 sans solde n\u2019est pas organis\u00e9 par la loi mais tr\u00e8s souvent, les conventions collectives pr\u00e9voient des dispositions particuli\u00e8res \u00e0 ce sujet. Il est donc imp\u00e9ratif de s\u2019y r\u00e9f\u00e9rer pour conna\u00eetre les conditions \u00e0 remplir pour en b\u00e9n\u00e9ficier.<\/p>\n

Le cong\u00e9 sans solde ne peut \u00eatre accord\u00e9 qu\u2019avec l\u2019accord de l\u2019employeur qui n\u2019est pas tenu d\u2019acc\u00e9der \u00e0 la demande du salari\u00e9. Ce consentement est essentiel puisque l\u2019absence du salari\u00e9, malgr\u00e9 un refus peut \u00eatre consid\u00e9r\u00e9e comme une absence injustifi\u00e9e pouvant donner lieu \u00e0 des sanctions disciplinaires et m\u00eame justifier un licenciement.<\/p>\n

Si l\u2019employeur souhaite accorder ce cong\u00e9, il doit s\u2019entendre avec le salari\u00e9 sur sa dur\u00e9e et ses modalit\u00e9s. Il est conseill\u00e9 au salari\u00e9 de se faire confirmer cet accord par \u00e9crit.<\/p>\n

Le cong\u00e9 sans solde entraine la suspension du contrat de travail. Le salari\u00e9 n\u2019est donc pas r\u00e9mun\u00e9r\u00e9. Cependant, dans certaines entreprises, le cong\u00e9 sans solde, lorsqu\u2019il est de courte dur\u00e9e, ne donne pas lieu \u00e0 une r\u00e9duction de salaire.<\/p>\n
