La loi impose aux employeurs des r\u00e8gles concernant le repos des salari\u00e9s. Ainsi, elle pr\u00e9voit qu\u2019il est interdit de faire travailler un salari\u00e9 plus de 6 jours <\/strong>par semaine. La\u00a0 dur\u00e9e du repos hebdomadaire ne peut \u00eatre inf\u00e9rieure \u00e0 35 heures\u00a0: elle inclue une journ\u00e9e de repos\u00a0 (24 heures) et les heures de repos quotidien du jour pr\u00e9c\u00e9demment travaill\u00e9 (11heures) .<\/p>\n
En principe, le dimanche est inclus dans les jours de repos hebdomadaire puisqu\u2019un employeur n\u2019a pas le droit de faire travailler une personne ce jour. Il existe cependant des d\u00e9rogations au repos dominical.<\/p>\n
Dans certains cas pr\u00e9cis, la r\u00e8gle du repos hebdomadaire du salari\u00e9<\/strong> peut ne pas \u00eatre respect\u00e9e. Par exemple, dans le cadre des activit\u00e9s saisonni\u00e8res, il peut \u00eatre en partie diff\u00e9r\u00e9, sous r\u00e9serve que chaque travailleur b\u00e9n\u00e9ficie de deux jours de repos par mois, si possible le dimanche. Egalement, les gardiens et concierges auxquels le repos hebdomadaire ne peut \u00eatre accord\u00e9 b\u00e9n\u00e9ficient d\u2019un repos compensateur.<\/p>\n
En dehors des cas pr\u00e9vus et strictement encadr\u00e9s par la loi, un employeur ne peut d\u00e9roger \u00e0 la r\u00e8gle du repos hebdomadaire du salari\u00e9<\/em>. Ainsi, faire travailler un salari\u00e9 plus de 6 jours ou le dimanche (sauf d\u00e9rogation) constitue une contravention de cinqui\u00e8me classe.
