Le plan de sauvegarde de l\u2019emploi est obligatoire d\u00e8s lors que le licenciement \u00e9conomique de 10 salari\u00e9s et plus est envisag\u00e9, sur une p\u00e9riode de trente jours, dans une entreprise de plus de 50 salari\u00e9s.<\/p>\n

Il a pour objet de mettre en \u0153uvre des mesures destin\u00e9es \u00e0 r\u00e9duire le nombre de licenciements \u00e9conomiques envisag\u00e9s ainsi que d\u2019assurer le reclassement des salari\u00e9s menac\u00e9s. Il est pr\u00e9sent\u00e9, en fonction de la taille de l\u2019entreprise, au comit\u00e9 d\u2019entreprise ou aux d\u00e9l\u00e9gu\u00e9s du personnel.\u00a0 A d\u00e9faut de repr\u00e9sentant du personnel il doit \u00eatre affich\u00e9 sur le lieux de travail.<\/p>\n

Le comit\u00e9 d\u2019entreprise ou les d\u00e9l\u00e9gu\u00e9s du personnel\u00a0 peuvent contester l\u2019absence ou l\u2019insuffisance de ce plan devant le tribunal de grande instance, dans les 12 mois qui suivent la derni\u00e8re r\u00e9union avec l\u2019employeur. Dans ce cas, les licenciements \u00e9conomiques seront alors consid\u00e9r\u00e9s comme nuls, entrainant ainsi la r\u00e9int\u00e9gration des salari\u00e9s dans l\u2019entreprise. Si celle ci est impossible ou non voulue par les salari\u00e9s concern\u00e9s, ces derniers pourront b\u00e9n\u00e9ficier d\u2019une indemnisation importante.<\/p>\n

Si l\u2019employeur n\u2019ex\u00e9cute pas les mesures pr\u00e9vues par le plan, les licenciements \u00e9conomiques peuvent \u00eatre consid\u00e9r\u00e9s sans cause r\u00e9elle et s\u00e9rieuse entrainant ainsi toutes les cons\u00e9quences li\u00e9es \u00e0 un tel licenciement.<\/p>\n

En l\u2019absence de repr\u00e9sentants du personnel dans l\u2019entreprise, ou si ces derniers n\u2019ont pas contest\u00e9 le plan, le salari\u00e9 concern\u00e9 qui l\u2019estime n\u00e9cessaire peut entamer une action individuelle en r\u00e9f\u00e9r\u00e9 devant le conseil de prud\u2019hommes pour faire valoir ses droits. La saisine du tribunal doit alors intervenir dans les douze mois qui suivent la r\u00e9ception de la lettre de licenciement.<\/p>\n
