Il s\u2019agit d\u2019\u00e9viter que le salari\u00e9, par ses activit\u00e9s, ne porte atteinte aux int\u00e9r\u00eats de son ancien employeur. Pour \u00eatre valable, la clause doit remplir quatre conditions\u00a0:<\/p>\n<ul>\n<li><strong>La clause doit \u00eatre limit\u00e9e\u00a0:<\/strong>\n<ul>\n<li><strong>\u00a0dans le temps\u00a0: <\/strong>la clause doit avoir une<strong> <\/strong>dur\u00e9e d\u00e9termin\u00e9e<\/li>\n<li><strong>\u00a0dans l\u2019espace\u00a0:<\/strong> la clause ne s\u2019applique que pour une certaine zone g\u00e9ographique (d\u00e9partement, r\u00e9gion)<\/li>\n<li><strong>L\u2019activit\u00e9 professionnelle interdite doit \u00eatre d\u00e9termin\u00e9e\u00a0<\/strong><\/li>\n<li><strong>La clause doit \u00eatre justifi\u00e9e\u00a0<\/strong>: l\u2019activit\u00e9 concurrente du salari\u00e9 doit \u00eatre susceptible de porter atteinte aux int\u00e9r\u00eats de l\u2019entreprise et de ce fait, lui porter pr\u00e9judice.<\/li>\n<li><strong>La clause doit comporter une contrepartie financi\u00e8re\u00a0<\/strong>: elle prend la forme d\u2019une somme vers\u00e9e par l\u2019employeur au moment de la rupture du contrat de travail (d\u00e9mission ou licenciement).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Une <strong>clause de non concurrence <\/strong>qui ne rempli pas ces quatre conditions est susceptible d\u2019\u00eatre consid\u00e9r\u00e9e comme <strong>abusive <\/strong>par les juges, et d\u2019ouvrir droit \u00e0 r\u00e9paration du pr\u00e9judice subi par le salari\u00e9.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La clause de non concurrence figure dans le contrat de travail ou est impos\u00e9e par la convention collective.\u00a0 Par cette clause, le salari\u00e9 qui part de l\u2019entreprise s\u2019interdit de s\u2019engager chez un concurrent ou de s\u2019\u00e9tablir \u00e0 son compte dans le m\u00eame secteur d\u2019activit\u00e9.
