La mise \u00e0 pied conservatoire vise \u00e0 \u00e9carter un salari\u00e9 de son poste de travail dans l’attente de la sanction \u00e0 intervenir. A la diff\u00e9rence de la mise \u00e0 pied disciplinaire, il ne s’agit pas d’une sanction mais d’une simple suspension du contrat de travail. L’employeur pourra donc prononcer une sanction \u00e0 la suite de cette mise \u00e0 pied.<\/strong><\/p>\n

Les conditions de mise en oeuvre de la mise \u00e0 pied conservatoire<\/strong><\/h2>\n

Tout d’abord, pour prononcer une mise \u00e0 pied conservatoire<\/strong> \u00e0 l’encontre d’un salari\u00e9, celui-ci doit avoir commis une faute grave ou lourde<\/strong> rendant impossible le maintien du salari\u00e9 dans l’entreprise.<\/p>\n

A l’issue de la proc\u00e9dure, m\u00eame si elle aboutit le plus souvent au licenciement du salari\u00e9, l’employeur peut aussi prononcer une sanction moindre, telle qu’une mise \u00e0 pied disciplinaire, une mutation, une r\u00e9trogradation. Il peut \u00e9galement renoncer \u00e0 prendre toute sanction apr\u00e8s l’entretien pr\u00e9alable.<\/p>\n

Dans tous les cas, la mise en oeuvre de la mise \u00e0 pied conservatoire<\/em> doit \u00eatre concomitante du d\u00e9clenchement de la proc\u00e9dure disciplinaire<\/strong>, m\u00eame si l’employeur se ravise en cours de proc\u00e9dure et d\u00e9cide soit de ne plus prononcer de sanction, soit de licencier le salari\u00e9 pour motif non disciplinaire. En effet, les juges ont pu d\u00e9cider qu’une mise \u00e0 pied intervenue six jours avant l’envoi de la convocation \u00e0 l’entretien pr\u00e9alable au licenciement pr\u00e9sentait un caract\u00e8re disciplinaire; l’employeur ne pouvait donc plus sanctionner deux fois le salari\u00e9 pour les m\u00eames faits.<\/p>\n

La proc\u00e9dure de la mise \u00e0 pied conservatoire<\/strong><\/h2>\n

Le Code du travail ne pr\u00e9voit aucun formalisme. L’employeur peut la prononcer verbalement<\/strong>, mais il en va de son int\u00e9r\u00eat de la notifier par \u00e9crit<\/strong>. Cette notification devra mentionner son caract\u00e8re conservatoire de mani\u00e8re pr\u00e9cise afin d’\u00e9viter toute ambigu\u00eft\u00e9. Le courrier devra faire r\u00e9f\u00e9rence \u00e0 la sanction envisag\u00e9e et pr\u00e9ciser la date de d\u00e9but de la mise \u00e0 pied. Sauf si une date de fin est indiqu\u00e9e, la mise \u00e0 pied conservatoire se terminera \u00e0 la fin de la proc\u00e9dure de licenciement.<\/p>\n

Les effets de la mise \u00e0 pied conservatoire<\/strong><\/h2>\n

Le salari\u00e9 est \u00e9cart\u00e9 de l’entreprise<\/strong>; par cons\u00e9quent, si l’entreprise lui demande de venir travailler, m\u00eame deux jours, pendant la mise \u00e0 pied, elle sera requalifi\u00e9e en mise \u00e0 pied disciplinaire.<\/p>\n

Par ailleurs, \u00e0 la diff\u00e9rence de la mise \u00e0 pied disciplinaire, la mise \u00e0 pied conservatoire est obligatoirement r\u00e9mun\u00e9r\u00e9e, sauf si la sanction d\u00e9finitive est un licenciement pour faute grave<\/strong>. Si l’employeur ne r\u00e9mun\u00e8re pas le salari\u00e9 alors qu’il fonde le licenciement sur une faute simple ou un motif non disciplinaire, la mise \u00e0 pied conservatoire sera analys\u00e9e en une sanction disciplinaire et l’employeur ne pourra plus prononcer d’autres sanctions \u00e0 l’\u00e9gard du salari\u00e9 pour les m\u00eames faits.<\/p>\n

En outre, l’employeur peut prononcer une mise \u00e0 pied conservatoire \u00e0 dur\u00e9e d\u00e9termin\u00e9e<\/strong> \u00e0 condition qu’il le fasse dans l’attente de sa d\u00e9cision dans la proc\u00e9dure de licenciement et que cette proc\u00e9dure ait \u00e9t\u00e9 engag\u00e9e.
