Quand elle est disciplinaire, c’est-\u00e0-dire qu’elle vise \u00e0 punir un comportement fautif du salari\u00e9, il s’agit d’une sanction. En revanche, la mise \u00e0 pied conservatoire n’est pas une sanction mais une suspension du contrat visant \u00e0 \u00e9carter le salari\u00e9 de son poste dans l’attente de la sanction d\u00e9finitive.<\/strong><\/p>\n

Les conditions de mise en oeuvre de la mise \u00e0 pied disciplinaire<\/strong><\/h2>\n

La mise \u00e0 pied disciplinaire<\/strong> doit \u00eatre pr\u00e9vue dans le r\u00e8glement int\u00e9rieur<\/strong>, tout comme sa dur\u00e9e<\/strong>. A d\u00e9faut, l’employeur ne peut pas y avoir recours.<\/p>\n

Quand l’employeur n’est pas tenu d’\u00e9tablir un r\u00e8glement int\u00e9rieur (dans les entreprises de moins de 20 salari\u00e9s), il faudra se r\u00e9f\u00e9rer \u00e0 la convention collective. Si celle-ci ne pr\u00e9voit rien, la mise \u00e0 pied disciplinaire devra dans tous les cas \u00eatre limit\u00e9e dans le temps<\/strong> et en cas de litige, les juges appr\u00e9cieront la dur\u00e9e raisonnable de la sanction selon les circonstances.<\/p>\n

La proc\u00e9dure \u00e0 suivre en cas de mise \u00e0 pied disciplinaire<\/strong><\/h2>\n

La proc\u00e9dure de la mise \u00e0 pied disciplinaire<\/em> repose sur deux \u00e9tapes:<\/p>\n

  • un entretien pr\u00e9alable<\/strong>: la convocation est envoy\u00e9e au salari\u00e9 par lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception ou remise en mains propres et doit contenir certaines mentions obligatoires. Pendant l’entretien, l’employeur expose les raisons pour lesquelles il envisage la sanction et le salari\u00e9 est invit\u00e9 \u00e0 s’expliquer.<\/li>\n
  • la lettre de notification<\/strong>: elle ne peut intervenir moins d’un jour franc ni plus d’un mois apr\u00e8s l’entretien. La loi n’impose pas de d\u00e9lai pour fixer la date \u00e0 laquelle le salari\u00e9 devra ex\u00e9cuter la sanction mais il va de soi que ce d\u00e9lai doit \u00eatre raisonnable.<\/li>\n<\/ul>\n

    Les cons\u00e9quences de la mise \u00e0 pied disciplinaire<\/strong><\/h2>\n

    Le salari\u00e9 est dispens\u00e9 de venir travailler dans l’entreprise et il ne sera donc pas r\u00e9mun\u00e9r\u00e9<\/strong> pendant la dur\u00e9e de la mise \u00e0 pied. Cette absence de salaire doit \u00eatre strictement \u00e9quivalente \u00e0 la dur\u00e9e de la mise \u00e0 pied, les sanctions p\u00e9cuniaires \u00e9tant interdites.<\/p>\n

    La mise \u00e0 pied disciplinaire ayant le caract\u00e8re d’une sanction, l’employeur ne pourra plus prononcer d’autres sanctions \u00e0 l’encontre du salari\u00e9 pour les m\u00eames faits.<\/p>\n

    Le refus d’ex\u00e9cution par le salari\u00e9<\/strong><\/h2>\n

    Le salari\u00e9 ne peut pas refuser d’ex\u00e9cuter la sanction; s’il persiste \u00e0 se rendre dans l’entreprise il s’expose \u00e0 une sanction plus grave. Il pourra la contester aupr\u00e8s du conseil de prud’hommes qui pourra annuler la mise \u00e0 pied. Dans ce cas, l’employeur devra payer le salaire dont le salari\u00e9 a \u00e9t\u00e9 priv\u00e9 pendant la sanction.<\/p>\n

    Le cas des repr\u00e9sentants du personnel<\/strong><\/h2>\n

    Une mise \u00e0 pied disciplinaire ne suspend pas le mandat repr\u00e9sentatif<\/strong> des salari\u00e9s, qui doivent pouvoir circuler librement dans l’entreprise pour y exercer leur mandat.
