La rupture du contrat de travail n’entra\u00eene pas forc\u00e9ment la perte des heures acquises au titre du DIF. Le salari\u00e9 peut en conserver le b\u00e9n\u00e9fice selon les types de rupture. Cela dit, la loi no<\/sup> 2014-288 du 5 mars 2014<\/a><\/span>\u00a0abroge, \u00e0 compter du 1er<\/sup> janvier 2015, le dispositif du droit individuel \u00e0 la formation, pour lui substituer un nouvel outil appel\u00e9 compte personnel de formation et les r\u00e8gles pr\u00e9sent\u00e9es ci-dessous n’auront plus vocation \u00e0 s’appliquer.<\/strong><\/p>\n

Les droits \u00e0 DIF en cas de licenciement<\/strong><\/h3>\n

Si le salari\u00e9 est licenci\u00e9 pour un autre motif qu’une faute lourde, il peut utiliser les heures acquises au titre du DIF et non utilis\u00e9es pour suivre\u00a0une action de bilan de comp\u00e9tences, de validation des acquis de l’exp\u00e9rience ou de formation, \u00e0 condition de le faire avant la fin de son pr\u00e9avis. L’employeur ne peut pas refuser la demande et doit financer\u00a0\u00e0 hauteur du solde d’heures acquises au titre du DIF et non utilis\u00e9es, multipli\u00e9 par le montant forfaitaire de 9,15 \u20ac indiqu\u00e9 \u00e0 l’article D. 6332-87 du Code du travail.\u00a0A d\u00e9faut d\u2019une telle demande, la somme n\u2019est pas due par l\u2019employeur.<\/p>\n

Le dispositif n’est pas applicable en cas de faute lourde du salari\u00e9.<\/p>\n

Les droits \u00e0 DIF en cas de d\u00e9mission<\/strong><\/h3>\n

En cas de d\u00e9mission, le salari\u00e9 peut demander \u00e0 b\u00e9n\u00e9ficier de son droit individuel \u00e0 la formation sous r\u00e9serve que l’action de bilan de comp\u00e9tences, de validation des acquis de l’exp\u00e9rience ou de formation soit engag\u00e9e avant la fin du pr\u00e9avis.<\/p>\n

L’employeur est cependant libre d’accepter ou de refuser la demande du salari\u00e9.<\/p>\n

Le DIF apr\u00e8s la cessation du contrat<\/strong><\/h3>\n

Le salari\u00e9 garde le b\u00e9n\u00e9fice de son DIF apr\u00e8s la rupture du contrat sauf faute lourde, ou apr\u00e8s le terme de son contrat, \u00e0 condition que cette fin de contrat ouvre droit \u00e0 une prise en charge par le r\u00e9gime d’assurance ch\u00f4mage.<\/p>\n

Si le salari\u00e9:<\/p>\n

    \n
  • est demandeur d’emploi<\/strong>: il peut demander \u00e0 P\u00f4le emploi de suivre une action de bilan de comp\u00e9tences, de VAE ou de formation. Cette action est prise en charge par l’organisme paritaire collecteur agr\u00e9\u00e9 dont rel\u00e8ve la derni\u00e8re entreprise dans laquelle les droits ont \u00e9t\u00e9 acquis.<\/li>\n
  • a retrouv\u00e9 un emploi<\/strong>: le salari\u00e9 peut demander le b\u00e9n\u00e9fice de son DIF<\/em> aupr\u00e8s du nouvel employeur au cours des 2 ans suivant son embauche et suivre\u00a0une action de bilan de comp\u00e9tences, de validation des acquis de l’exp\u00e9rience ou de formation.\u00a0Lorsque le salari\u00e9 et l\u2019employeur sont en d\u00e9saccord, l\u2019action se d\u00e9roule hors temps de travail et l\u2019allocation de formation (vis\u00e9e \u00e0 l\u2019article L. 6321-10 du code du travail) n\u2019est pas due par l\u2019employeur.\u00a0Dans tous les cas, l’action suivie par le salari\u00e9 est financ\u00e9e par l’Opca dont rel\u00e8ve le nouvel employeur.<\/li>\n<\/ul>\n
