Le Perco (plan d’\u00e9pargne pour la retraite collectif) est un dispositif d’\u00e9pargne salariale facultatif en vue de la retraite. Il permet aux salari\u00e9s de se constituer une \u00e9pargne-retraite dans un cadre professionnel, avec l’aide de l’entreprise. Il est r\u00e9gi par les r\u00e8gles applicables au plan d’\u00e9pargne d’entreprise, sauf quelques dispositions particuli\u00e8res.<\/strong><\/p>\n

La mise en place du Perco<\/strong><\/h2>\n

Pour que l’entreprise puisse \u00eatre en mesure de mettre en place un Perco, ses salari\u00e9s doivent avoir la possibilit\u00e9 d’opter pour un plan d’\u00e9pargne plus courte dans le cadre d’un PEE ou d’un PEI.<\/p>\n

Le Perco<\/em> est normalement institu\u00e9 par accord<\/strong>; la n\u00e9gociation du plan avec le personnel est obligatoire quand l’entreprise comporte au moins un d\u00e9l\u00e9gu\u00e9 syndical ou est dot\u00e9e d’un comit\u00e9 d’entreprise. Si aucun accord n’est conclu au terme de la n\u00e9gociation, il\u00a0peut \u00eatre mis en place par d\u00e9cision unilat\u00e9rale de l’employeur<\/strong>. Il en va de m\u00eame pour les entreprises n’ayant ni comit\u00e9 d’entreprise, ni d\u00e9l\u00e9gu\u00e9 syndical.<\/p>\n

Le Perco<\/span><\/span> peut pr\u00e9voir une adh\u00e9sion automatique des salari\u00e9s qui ne manifesteraient pas d’avis contraire sous 15 jours suivant l’information de l’entreprise.<\/p>\n

L’alimentation du Perco<\/strong><\/h2>\n

Le Perco peut recevoir deux types de versements:<\/p>\n

    \n
  • en argent<\/strong> (versements volontaires des participants, sommes per\u00e7ues au titre de l’int\u00e9ressement et de la participation, abondements\u00a0de l’entreprise, sommes provenant d’un PEE ou d’un PEI), sachant que les sommes vers\u00e9es hors participation ne peuvent exc\u00e9der 25% de la r\u00e9mun\u00e9ration habituelle du b\u00e9n\u00e9ficiaire et que le montant annuel de l’abondement est \u00e9galement soumis \u00e0 des limites;<\/p>\n<\/li>\n
  • \n

    en temps<\/strong> (droits inscrits au compte \u00e9pargne-temps ou, pour les entreprises ne disposant pas d’un compte \u00e9pargne-temps, les jours de repos ou de cong\u00e9s non pris dans la limite de 5 jours par an).<\/p>\n<\/li>\n<\/ul>\n

    Contrairement au PEE, tous les anciens salari\u00e9s d’une entreprise peuvent continuer \u00e0 effectuer des versementsdessus.<\/p>\n

    Le Perco<\/span><\/span> ne peut servir de support aux dispositifs d’actionnariat salari\u00e9.<\/p>\n

    3 modalit\u00e9s de placement minimum<\/strong><\/h2>\n

    Pour permettre la constitution d’un compl\u00e9ment de retraite, les participants au plan doivent b\u00e9n\u00e9ficier d’un choix entre 3 organismes de placement collectif en valeurs mobili\u00e8res pr\u00e9sentant diff\u00e9rents profils d’investissement. Les placements propos\u00e9s doivent pr\u00e9senter plusieurs sp\u00e9cificit\u00e9s en terme de:<\/p>\n

      \n
    • diversification (au moins 3 organismes de placement collectif en valeurs mobili\u00e8res);<\/p>\n<\/li>\n
    • \n

      liquidation (des organismes facilement et rapidement n\u00e9gociables sur le march\u00e9);<\/p>\n<\/li>\n

    • \n

      s\u00e9curisation (garanties de s\u00e9curit\u00e9 du capital investi).<\/p>\n<\/li>\n<\/ul>\n

      Indisponibilit\u00e9 des sommes<\/strong><\/h2>\n

      Les sommes ou valeurs inscrites sur le Perco doivent \u00eatre d\u00e9tenues jusqu’au d\u00e9part \u00e0 la retraite. Elles peuvent, dans certains cas exceptionnels, \u00eatre d\u00e9bloqu\u00e9es sur leur demande avant le d\u00e9part \u00e0 la retraite.<\/p>\n

      R\u00e9gime social et fiscal<\/strong><\/h2>\n

      Le r\u00e9gime est le m\u00eame que celui du PEE mais le Perco comporte certaines particularit\u00e9s:<\/p>\n

      –\u00a0l’abondement b\u00e9n\u00e9ficie des avantages fiscaux et sociaux dans la limite de 16\u00a0% du plafond annuel de la s\u00e9curit\u00e9 sociale par an et par salari\u00e9 sans pouvoir exc\u00e9der le triple des versements du salari\u00e9;<\/p>\n

      –\u00a0si l’abondement d\u00e9passe, par salari\u00e9 et par an, 2\u00a0300\u00a0\u20ac, l’exc\u00e9dent est assujetti \u00e0 une contribution sp\u00e9ciale de 8,2\u00a0% \u00e0 la charge des employeurs et recouvr\u00e9e par les Urssaf;<\/p>\n

      –\u00a0l’abondement ouvre droit pour l’entreprise \u00e0 la constitution, en franchise d’imp\u00f4t, d’une provision pour investissement \u00e9gale \u00e0 25\u00a0% de son montant.<\/p>\n","protected":false},"excerpt":{"rendered":"
