L’accord d’int\u00e9ressement ne peut \u00eatre d\u00e9nonc\u00e9 ou modifi\u00e9 que par l’ensemble des signataires et dans les m\u00eames formes que sa conclusion. Cependant, pour\u00a0respecter le caract\u00e8re al\u00e9atoire de l’int\u00e9ressement, un accord ne peut \u00eatre ni modifi\u00e9, ni d\u00e9nonc\u00e9 avant qu’il n’ait \u00e9t\u00e9 appliqu\u00e9 \u00e0 au moins un exercice dont les r\u00e9sultats n’\u00e9taient ni connus ni pr\u00e9visibles.<\/strong><\/p>\n

La modification d’un accord d’int\u00e9ressement<\/strong><\/h2>\n

Il est n\u00e9cessaire d’obtenir l’accord de l’ensemble des signataires (employeur, syndicats, repr\u00e9sentants du personnel ou personnel lui-m\u00eame). Le processus est le m\u00eame que celui de l’accord lui-m\u00eame, c’est-\u00e0-dire qu’il faut entamer une n\u00e9gociation puis conclure un avenant suivant la m\u00eame forme et avec les m\u00eames partenaires que pour la n\u00e9gociation de l’accord d’int\u00e9ressement initial. Il faudra ensuite respecter les m\u00eames d\u00e9lais pour le d\u00e9p\u00f4t aupr\u00e8s de la Direccte que pour le d\u00e9p\u00f4t de l’accord initial, soit 15 jours.<\/p>\n

La d\u00e9nonciation d’un accord d’int\u00e9ressement<\/strong><\/h2>\n

Chaque partie signataire peut d\u00e9noncer l’accord d’int\u00e9ressement<\/em> afin qu’il cesse de produire ses effets par courrier et notification aux autres signataires de l’accord. Il faut ensuite notifier la d\u00e9nonciation \u00e0 la Direccte et informer\/consulter le comit\u00e9 d’entreprise.<\/p>\n

Que devient l’accord en cas de transfert d’entreprise?<\/strong><\/h2>\n

En cas de fusion, scission, cession, rachat, etc. remettant en cause l’identit\u00e9 juridique de l’entreprise et rendant impossibles l’application et la continuit\u00e9 de l’accord d’int\u00e9ressement, celui-ci cesse de produire ses effets. Quand le nouvel employeur est d\u00e9j\u00e0 couvert par un accord d’int\u00e9ressement, les salari\u00e9s transf\u00e9r\u00e9s en b\u00e9n\u00e9ficient. Sinon, la nouvelle entreprise doit engager dans un d\u00e9lai de 6 mois une n\u00e9gociation en vue de la conclusion \u00e9ventuelle d’un nouvel accord.<\/p>\n
