Cr\u00e9\u00e9 par la loi du 4 ao\u00fbt 1982, l’article L.1132-1 (issu de l’article L.122-45 de l’ancien Code du travail) instaurant le principe de non-discrimination vise l’embauche, l’ex\u00e9cution et la rupture du contrat de travail. Il interdit \u00e0 l’employeur de prendre en compte des \u00e9l\u00e9ments inh\u00e9rents \u00e0 la personne du salari\u00e9 (comme son \u00e2ge) ou ses activit\u00e9s (comme son appartenance \u00e0 un syndicat) pour prendre une mesure le concernant. Il s’agit v\u00e9ritablement d’\u00e9carter tout crit\u00e8re d’ordre personnel lors du processus de d\u00e9cision de l’employeur afin de pr\u00e9venir toute rupture d’\u00e9galit\u00e9 entre les salari\u00e9s.<\/strong><\/p>\n

Qu’est-ce qu’une discrimination ?<\/strong><\/h2>\n

La loi n\u00b02008-496 du 27 mai 2008\u00a0portant diverses dispositions d’adaptation au droit communautaire dans le domaine de la lutte contre les discriminations instaure d\u00e8s son premier article une diff\u00e9rence entre:<\/p>\n

    \n
  • la\u00a0discrimination directe<\/strong>, qui concerne \u00ab\u00a0la situation dans laquelle, sur le fondement de son appartenance ou de sa non-appartenance, vraie ou suppos\u00e9e, \u00e0 une ethnie ou une race, sa religion, ses convictions, son \u00e2ge, son handicap, son orientation ou identit\u00e9 sexuelle, son sexe ou son lieu de r\u00e9sidence, une personne est trait\u00e9e de mani\u00e8re moins favorable qu’une autre ne l’est, ne l’a \u00e9t\u00e9 ou ne l’aura \u00e9t\u00e9 dans une situation comparable<\/em>\u00ab\u00a0, et;<\/p>\n<\/li>\n
  • \n

    la discrimination indirecte<\/strong>, \u00ab\u00a0une disposition, un crit\u00e8re ou une pratique neutre en apparence, mais susceptible d’entra\u00eener, pour l’un des motifs mentionn\u00e9s au premier alin\u00e9a, un d\u00e9savantage particulier pour des personnes par rapport \u00e0 d’autres personnes, \u00e0 moins que cette disposition, ce crit\u00e8re ou cette pratique ne soit objectivement justifi\u00e9 par un but l\u00e9gitime et que les moyens pour r\u00e9aliser ce but ne soient n\u00e9cessaires et appropri\u00e9s<\/em>\u00ab\u00a0.<\/p>\n<\/li>\n<\/ul>\n

    Ce qui est v\u00e9ritablement interdit \u00e0 l’employeur, c’est de proc\u00e9der \u00e0 une \u00e9valuation globale d’un salari\u00e9 en prenant uniquement et d\u00e9favorablement en compte, ce qu’il est<\/em> (en fonction par exemple de son sexe ou de son origine) et ce qu’il fait<\/em> (en fonction par exemple de ses opinions politiques ou de son exercice normal du droit de gr\u00e8ve qui, rappelons-le, est constitutionnellement prot\u00e9g\u00e9).<\/p>\n

    Quelles sont les discriminations prohib\u00e9es ?<\/strong><\/h2>\n

    Malgr\u00e9 son pouvoir de direction, l’employeur doit faire usage de crit\u00e8res licites<\/strong> quand il veut arr\u00eater une d\u00e9cision vis-\u00e0-vis d’un salari\u00e9. Aujourd’hui, l’article L.1132-1 du Code du travail \u00e9num\u00e8re une vingtaine de discriminations prohib\u00e9es<\/strong>, la liste s’allongeant d’ann\u00e9e en ann\u00e9e. Elle comprend l’interdiction pour l’employeur de sanctionner, licencier ou arr\u00eater une mesure discriminatoire vis-\u00e0-vis d’un salari\u00e9 en vertu notamment de son\u00a0origine, son\u00a0sexe, ses\u00a0m\u0153urs, son orientation ou identit\u00e9 sexuelle, son \u00e2ge, sa situation de famille ou sa grossesse, son appartenance ou sa non-appartenance, vraie ou suppos\u00e9e, \u00e0 une ethnie, une nation ou une race, ses opinions politiques, ses activit\u00e9s syndicales ou mutualistes, ses convictions religieuses, son apparence physique, son\u00a0patronyme, son\u00a0lieu de r\u00e9sidence, son \u00e9tat de sant\u00e9 ou son\u00a0handicap.<\/p>\n

    Par exemple, le fait de demander \u00e0 un salari\u00e9 de porter un pr\u00e9nom fran\u00e7ais au lieu de son pr\u00e9nom d’origine \u00e9trang\u00e8re constitue une discrimination directe fond\u00e9e sur l’origine.<\/p>\n

    Le principe de non-discrimination est applicable \u00e0 tous les employeurs et salari\u00e9s et droit priv\u00e9 et au personnel employ\u00e9 par une personne publique dans les conditions de droit priv\u00e9<\/strong>.<\/p>\n
