Le Contrat Unique d\u2019Insertion (CUI-CIE), quand il est mis en \u0153uvre dans le secteur marchand, prend la forme d\u2019un Contrat Initiative Emploi. Il peut \u00eatre mobilis\u00e9 diff\u00e9remment selon les r\u00e9gions, dans des conditions fix\u00e9es par le pr\u00e9fet de r\u00e9gion et appr\u00e9ci\u00e9es par les acteurs du service public de l\u2019emploi tels que P\u00f4le emploi.<\/strong><\/p>\n

Quelle est la dur\u00e9e du CUI-CIE\u00a0?<\/strong><\/h2>\n

Le CUI-CIE<\/strong> peut \u00eatre conclu pour une dur\u00e9e d\u00e9termin\u00e9e ou ind\u00e9termin\u00e9e.<\/p>\n

En cas de conclusion d\u2019un CDD, le contrat est conclu pour 6 mois minimum, et 24 mois maximum, prolongations comprises, \u00e0 l\u2019exception des travailleurs handicap\u00e9s et des salari\u00e9s \u00e2g\u00e9s de 50 ans et plus et b\u00e9n\u00e9ficiaires du RSA et de certaines aides telles que l\u2019allocation de solidarit\u00e9 sp\u00e9cifique, pour qui le contrat peut \u00eatre prolong\u00e9 jusqu\u2019\u00e0 60 mois.<\/p>\n

Le CUI-CIE conclu en CDD<\/em> sera r\u00e9gi par l\u2019article L.1242-3 du Code du travail\u00a0: \u00e0 ce titre, l\u2019employeur n\u2019aura pas \u00e0 respecter de d\u00e9lai de carence entre deux CDD ni \u00e0 verser l\u2019indemnit\u00e9 de fin de contrat.<\/p>\n

Quel est le statut du salari\u00e9 en CUI-CIE\u00a0?<\/strong><\/h2>\n

Le salari\u00e9 est un salari\u00e9 \u00e0 part enti\u00e8re qui b\u00e9n\u00e9ficie des m\u00eames conditions de travail que les autres salari\u00e9s dans l\u2019entreprise, ainsi que de l\u2019ensemble des dispositions des conventions et accords collectifs applicables dans l\u2019entreprise.<\/p>\n

Sa r\u00e9mun\u00e9ration ne peut \u00eatre inf\u00e9rieure au SMIC.<\/p>\n

Quelle est la dur\u00e9e du travail\u00a0?<\/strong><\/h2>\n

Selon l\u2019article L.5134-70-1 du Code du travail, la dur\u00e9e ne peut \u00eatre inf\u00e9rieure \u00e0 20h par semaine sauf exceptions. Mais le contrat peut aussi \u00eatre conclu \u00e0 temps plein.<\/p>\n

Le salari\u00e9 b\u00e9n\u00e9ficiaire d\u2019un CUI-CIE peut-il suspendre ou rompre son contrat\u00a0?<\/strong><\/h2>\n

Le salari\u00e9 est autoris\u00e9 \u00e0 suspendre son contrat si elle lui permet\u00a0:<\/p>\n

    \n
  • En accord avec son employeur, d’effectuer une \u00e9valuation en milieu de travail prescrite par P\u00f4le emploi<\/strong> ou une action concourant \u00e0 son insertion professionnelle\u00a0<\/strong>;<\/li>\n
  • d’accomplir une p\u00e9riode d’essai aff\u00e9rente \u00e0 une offre d’emploi visant une embauche en CDI ou en CDD d’au moins six mois<\/strong>.<\/li>\n<\/ul>\n

    En cas d’embauche \u00e0 l’issue de cette \u00e9valuation en milieu de travail ou de cette p\u00e9riode d’essai, le contrat est rompu sans pr\u00e9avis.<\/p>\n

    Si le salari\u00e9 souhaite rompre son contrat avant son terme, il est autoris\u00e9 \u00e0 le faire si cette rupture lui permet d\u2019\u00eatre embauch\u00e9 en CDD pour au moins 6 mois, d\u2019\u00eatre embauch\u00e9 en CDI ou de suivre une formation qui lui permettra de progresser au cours de sa vie professionnelle d\u2019au moins un niveau.<\/p>\n

    En cas de suspension ou de rupture du contrat, l\u2019employeur a 7 jours pour le signaler \u00e0 l\u2019autorit\u00e9 qui a attribu\u00e9 l\u2019aide et \u00e0 l\u2019organisme qui verse l\u2019aide.<\/p>\n

    Il doit remettre au salari\u00e9 une attestation d\u2019exp\u00e9rience professionnelle, au plus tard 1 mois avant la fin du CUI.<\/p>\n
