Le Contrat Unique d\u2019Insertion fait partie des contrats aid\u00e9s. A ce titre, sa conclusion doit respecter une formalit\u00e9 obligatoire. Ce sont les formalit\u00e9s de mise en oeuvre du CUI, \u00e0 savoir l\u2019obtention d\u2019une aide financi\u00e8re pr\u00e9alable, qui comporte diff\u00e9rentes \u00e9tapes.<\/strong><\/p>\n

Une demande d\u2019aide financi\u00e8re conjointe<\/strong><\/h2>\n

La demande d\u2019aide financi\u00e8re \u00e0 l\u2019insertion professionnelle doit \u00eatre faite par l\u2019employeur et par le salari\u00e9<\/strong>, par le biais d\u2019un formulaire Cerfa unique qu\u2019ils signent tous les deux. Ils doivent adresser ce formulaire\u00a0:<\/p>\n

    \n
  • A P\u00f4le emploi ou l\u2019un des organismes participant au service public de l\u2019emploi\u00a0;<\/li>\n
  • Lorsque la demande concerne un b\u00e9n\u00e9ficiaire du RSA, au pr\u00e9sident du Conseil g\u00e9n\u00e9ral.<\/li>\n<\/ul>\n

    La demande d\u2019aide financi\u00e8re doit comporter un certain nombre de mentions obligatoires, comme par exemple l\u2019identit\u00e9 du b\u00e9n\u00e9ficiaire et sa situation, l\u2019identit\u00e9 de l\u2019employeur, ou encore la nature du contrat conclu avec le salari\u00e9. Elle doit aussi faire \u00e9tat des modalit\u00e9s de mise en \u0153uvre de la convention individuelle, qui peut d\u2019ailleurs \u00eatre modifi\u00e9e avant son terme avec l\u2019accord des 3 parties.<\/p>\n

    Quelle est la dur\u00e9e de l\u2019aide financi\u00e8re\u00a0?<\/strong><\/h2>\n

    La dur\u00e9e de l\u2019aide correspond, en toute logique, \u00e0 la dur\u00e9e du contrat. Elle ne peut d\u00e9passer 24 mois.<\/p>\n

    A titre exceptionnel et pour certaines situations uniquement, la convention peut \u00eatre prorog\u00e9e par le biais d\u2019un avenant, pour une dur\u00e9e maximale et totale de 5 ans. Cette exception concerne les travailleurs handicap\u00e9s, et les personnes de plus de 50 ans b\u00e9n\u00e9ficiaires du RSA et de certaines aides comme l\u2019allocation de solidarit\u00e9 sp\u00e9cifique. Elle peut aussi permettre au b\u00e9n\u00e9ficiaire d\u2019achever une action de formation professionnelle en cours de r\u00e9alisation et pr\u00e9vue dans la convention. Afin de ne pas interrompre la formation, une prolongation peut \u00eatre accord\u00e9e jusqu\u2019au terme de l\u2019action de formation.<\/p>\n

    L\u2019article R. 5134-34 pr\u00e9voit un autre cas de prolongation au-del\u00e0 de 24 mois sp\u00e9cifique au CAE (Contrat d\u2019Accompagnement dans l\u2019Emploi)\u00a0pour les salari\u00e9s \u00e2g\u00e9s d’au moins 50 ans ou reconnus travailleurs handicap\u00e9s, embauch\u00e9s dans des ateliers et chantiers d’insertion, qui rencontrent des difficult\u00e9s particuli\u00e8res faisant obstacle \u00e0 leur insertion durable dans l’emploi.<\/p>\n

    En tout \u00e9tat de cause, si l\u2019employeur souhaite prolonger la convention initiale, il doit adresser \u00e0 l\u2019autorit\u00e9 signataire de la convention une demande motiv\u00e9e et accompagn\u00e9e de documents<\/strong>\u00a0:<\/p>\n

      \n
    • Un bilan<\/strong> des actions r\u00e9alis\u00e9es en mati\u00e8re d\u2019accompagnement et de formation ou, pour le CAE, de la r\u00e9alisation d\u2019une p\u00e9riode d\u2019immersion\u00a0;<\/li>\n
    • Un document r\u00e9pertoriant les actions d\u2019accompagnement et de formation envisag\u00e9es<\/strong> pendant la prolongation.<\/li>\n<\/ul>\n

      Quels sont les risques si l\u2019employeur ne respecte pas les termes de la d\u00e9cision d\u2019attribution d\u2019aide\u00a0financi\u00e8re\u00a0?<\/strong><\/h2>\n

      L\u2019employeur devra rembourser la totalit\u00e9 des sommes per\u00e7ues.<\/p>\n

      Que faire en cas de refus d\u2019attribution d\u2019aide\u00a0?<\/strong><\/h2>\n

      L\u2019employeur ou le futur salari\u00e9 peuvent, sous 2 mois \u00e0 partir de la notification de la d\u00e9cision\u00a0:<\/p>\n

      • Faire un recours gracieux aupr\u00e8s de l\u2019organisme ayant refus\u00e9 d\u2019attribuer l\u2019aide financi\u00e8re\u00a0;<\/li>\n
      • Adresser un recours hi\u00e9rarchique aupr\u00e8s de la direction g\u00e9n\u00e9rale de P\u00f4le emploi, devant le pr\u00e9fet de r\u00e9gion ou devant la Direccte, selon les cas\u00a0;<\/li>\n
      • Engager un recours contentieux devant le tribunal administratif comp\u00e9tent.<\/li>\n<\/ul>\n
