Pour les entreprises de 300 salari\u00e9s et plus, aucune aide n\u2019est pr\u00e9vue dans le cadre des modalit\u00e9s de mise en \u0153uvre du contrat de g\u00e9n\u00e9ration. Elles sont soumises \u00e0 une obligation de n\u00e9gocier un accord interg\u00e9n\u00e9rationnel ou, en cas d\u2019\u00e9chec de la n\u00e9gociation, de mettre en place un plan d\u2019action. A ce titre, cette obligation fait l\u2019objet de contr\u00f4les.<\/strong><\/p>\n

Par qui l\u2019accord ou le plan d\u2019action du contrat de g\u00e9n\u00e9ration sont-ils valid\u00e9s\u00a0?<\/strong><\/h2>\n

Selon l\u2019article R. 5121-29 du Code du travail, l\u2019accord ou le plan d\u2019action pour la mise en place d’un contrat de g\u00e9n\u00e9ration<\/em> doivent \u00eatre d\u00e9pos\u00e9s aupr\u00e8s de l\u2019administration avec le diagnostic pr\u00e9alable ayant servi de base pour la n\u00e9gociation, ainsi qu\u2019une fiche descriptive de son contenu.<\/p>\n

Dans le cas o\u00f9 l\u2019entreprise a \u00e9tabli un plan d\u2019action en cas d\u2019\u00e9chec de la n\u00e9gociation, elle doit joindre le proc\u00e8s-verbal de d\u00e9saccord et l\u2019avis du comit\u00e9 d\u2019entreprise ou du d\u00e9l\u00e9gu\u00e9 du personnel sur le plan d\u2019action.<\/p>\n

La Direccte (Direction r\u00e9gionale des entreprises, de la concurrence, de la consommation, du travail et de l\u2019emploi) contr\u00f4le la conformit\u00e9 de l\u2019accord sous 3 semaines, ou du plan d\u2019action sous 6 semaines.<\/p>\n

Par la suite, l\u2019entreprise se trouve face \u00e0 2 possibilit\u00e9s\u00a0:<\/p>\n

    \n
  • Soit la Direccte rend un avis de conformit\u00e9 ou de non-conformit\u00e9\u00a0;<\/li>\n
  • Soit la Direccte ne rend pas de d\u00e9cision dans le d\u00e9lai. Dans ce cas, l\u2019accord ou le plan d\u2019action est r\u00e9put\u00e9 conforme.<\/li>\n<\/ul>\n

    Comment s\u2019organise le suivi de la mise en \u0153uvre du dispositif\u00a0?<\/strong><\/h2>\n

    Selon les articles L. 5121-15 et R. 5121-37 du Code du travail, il est exig\u00e9 de l\u2019entreprise qu\u2019elle transmette chaque ann\u00e9e \u00e0 la Direccte un document d\u2019\u00e9valuation de la mise en \u0153uvre du dispositif.<\/p>\n

    Si l\u2019entreprise ne respecte pas cette obligation, la DIRECCTE\u00a0proc\u00e9dera \u00e0 une mise en demeure de lui communiquer le document sous 1 mois.<\/p>\n

    Si l\u2019entreprise ne transmet pas le document, elle s\u2019expose \u00e0 une p\u00e9nalit\u00e9 de 1\u00a0500\u20ac pour chaque mois pour lequel elle n\u2019a pas transmis le document.<\/p>\n

    L\u2019entreprise peut-elle \u00eatre sanctionn\u00e9e en cas de non-respect de l\u2019obligation de n\u00e9gociation ou de non-conformit\u00e9 de l\u2019accord ou du plan d\u2019action\u00a0?<\/strong><\/h2>\n

    L\u2019entreprise encourt une p\u00e9nalit\u00e9 financi\u00e8re<\/strong> si elle ne respecte pas son obligation de n\u00e9gocier sur la mise en place de contrats de g\u00e9n\u00e9ration, ou si l\u2019accord ou le plan d\u2019action n\u2019est pas conforme.<\/p>\n

    Cette p\u00e9nalit\u00e9 est calcul\u00e9e de la fa\u00e7on suivante\u00a0:<\/p>\n

      \n
    • 1% des r\u00e9mun\u00e9rations vers\u00e9es aux salari\u00e9s pour la p\u00e9riode pendant laquelle il n\u2019y a pas d\u2019accord ou de plan d\u2019action conforme<\/li>\n
    • 10% du montant de la r\u00e9duction \u00ab\u00a0Fillon\u00a0\u00bb dont l\u2019entreprise b\u00e9n\u00e9ficie.<\/li>\n<\/ul>\n

      Le taux de p\u00e9nalit\u00e9 prend en compte les efforts de l\u2019entreprise concernant par exemple l\u2019\u00e9tablissement d\u2019un diagnostic pr\u00e9alable.<\/p>\n

      Bien entendu, avant de sanctionner l\u2019entreprise, la Direccte lui adresse une mise en demeure de r\u00e9gulariser sa situation, avec un d\u00e9lai compris entre 1 et 4 mois.<\/p>\n

      Si l\u2019entreprise est tout de m\u00eame sanctionn\u00e9e, elle doit verser la p\u00e9nalit\u00e9 \u00e0 l\u2019organisme en charge du recouvrement des cotisations de s\u00e9curit\u00e9 sociale.<\/p>\n
