Pour mettre en place le dispositif du contrat de g\u00e9n\u00e9ration, quand une entreprise emploie 300 salari\u00e9s et plus, elle doit obligatoirement n\u00e9gocier un accord ou mettre en place un plan d\u2019action en cas d\u2019\u00e9chec de la n\u00e9gociation. Contrairement aux entreprises de moins de 300 salari\u00e9s, elle ne b\u00e9n\u00e9fice d\u2019aucune aide, et les obligations auxquelles elle est soumise sont tr\u00e8s pr\u00e9cises.<\/strong><\/p>\n

L\u2019entreprise doit obligatoirement n\u00e9gocier le contrat de g\u00e9n\u00e9ration<\/strong><\/h2>\n

Toute entreprise qui emploie 300 salari\u00e9s ou plus doit \u00eatre couverte par un accord collectif d\u2019entreprise ou de groupe<\/strong> ou, \u00e0 d\u00e9faut, par un plan d\u2019action<\/strong>. Il s\u2019agit d\u2019une obligation pr\u00e9vue par l\u2019article L.5121-9 du Code du travail, sanctionn\u00e9e par une p\u00e9nalit\u00e9 financi\u00e8re en cas de non-respect.<\/p>\n

Si la n\u00e9gociation \u00e9choue, l\u2019entreprise doit \u00e9tablir un plan d\u2019action<\/strong>. L\u2019employeur et les d\u00e9l\u00e9gu\u00e9s syndicaux ou les repr\u00e9sentants du personnel avec qui la n\u00e9gociation a \u00e9t\u00e9 conduite doivent signer un proc\u00e8s-verbal de d\u00e9saccord<\/strong>.<\/p>\n

L\u2019entreprise doit r\u00e9aliser un diagnostic pr\u00e9alable \u00e0 la n\u00e9gociation<\/strong><\/h2>\n

Pr\u00e9vu par l\u2019article L.5121-10, ce diagnostic permet d\u2019\u00e9valuer \u00ab\u00a0la mise en \u0153uvre des engagements pris ant\u00e9rieurement par l’entreprise, le groupe ou la branche concernant l’emploi des salari\u00e9s \u00e2g\u00e9s<\/em>\u00a0\u00bb, et il \u00ab\u00a0s’appuie sur les objectifs et mesures relatifs \u00e0 l’\u00e9galit\u00e9 professionnelle entre les femmes et les hommes mentionn\u00e9s aux\u00a0<\/em>articles L. 2241-3\u00a0<\/a>et\u00a0L. 2242-5<\/a><\/em>\u00a0\u00bb.<\/p>\n

Il permet donc, concr\u00e8tement, de faire une sorte d\u2019\u00e9tat des lieux de la situation<\/strong> concernant l\u2019emploi des salari\u00e9s \u00e2g\u00e9s pr\u00e9alablement \u00e0 la n\u00e9gociation pour servir de base \u00e0 celle-ci.<\/p>\n

Cette obligation d\u2019\u00e9tablir un diagnostic pr\u00e9alable s\u2019applique tant pour un accord que pour un plan d\u2019action.<\/p>\n

L\u2019entreprise doit formuler des engagements pr\u00e9cis dans le contrat de g\u00e9n\u00e9ration<\/strong><\/h2>\n

L\u2019accord r\u00e9sultant de la n\u00e9gociation est applicable pour une dur\u00e9e maximale de 3 ans<\/strong>, tout comme le plan d\u2019action. L\u2019article L.5121-11 \u00e9tablit une liste tr\u00e8s pr\u00e9cise des \u00e9l\u00e9ments que l\u2019accord doit comporter et des engagements que l\u2019entreprise doit respecter. A ce titre, l\u2019entreprise doit s\u2019engager en faveur de la formation et de l\u2019insertion durable des jeunes dans l\u2019emploi, l\u2019emploi des salari\u00e9s \u00e2g\u00e9s et la transmission des savoirs et des comp\u00e9tences<\/strong>.<\/p>\n

L\u2019accord ou le plan d\u2019action doivent aussi d\u00e9finir un certain nombre d\u2019\u00e9l\u00e9ments, telles que les tranches d\u2019\u00e2ge des jeunes et des seniors concern\u00e9s par les engagements de l\u2019employeur ou les mesures destin\u00e9es \u00e0 favoriser l\u2019am\u00e9lioration des conditions de travail des seniors et la pr\u00e9vention de la p\u00e9nibilit\u00e9.<\/p>\n
