M. X…, employ\u00e9 par une Soci\u00e9t\u00e9 d’\u00e9conomie mixte de transports en qualit\u00e9 de conducteur receveur, avait \u00e9t\u00e9 affect\u00e9 sur des lignes de tramway en soir\u00e9e. Suite d’un incident, il s’est vu retirer son habilitation \u00e0 la conduite des tramways par son employeur et a \u00e9t\u00e9 affect\u00e9 \u00e0 la conduite d’une ligne d’autobus en journ\u00e9e. Le salari\u00e9 a saisi la formation de r\u00e9f\u00e9r\u00e9 de la juridiction prud’homale aux fins d’obtenir des mesures de remise en \u00e9tat. Il faisait valoir que cette d\u00e9cision constituait une sanction disciplinaire et, qu\u2019ayant \u00e9t\u00e9 mise en \u0153uvre sans consultation du conseil de discipline, elle caract\u00e9risait un trouble manifestement illicite,<\/p>\n

Dans un arr\u00eat du 19 janvier 2010 rendu en r\u00e9f\u00e9r\u00e9, la cour d’appel de Chamb\u00e9ry a rejet\u00e9 la demande du salari\u00e9 au motif qu\u2019aucun \u00e9l\u00e9ment ne vient caract\u00e9riser l’existence d’une voie de fait ou d’un trouble manifestement illicite, alors que la d\u00e9cision d’affecter M. X…sur une ligne de bus ne constitue pas une sanction disciplinaire m\u00eame d\u00e9guis\u00e9e, mais qu’elle correspond \u00e0 l’exercice du pouvoir de gestion normal de l’employeur, libre d’affecter un salari\u00e9 \u00e0 une autre t\u00e2che sauf abus de droit. Ainsi, cette d\u00e9cision n\u2019appara\u00eet pour la Cour d\u2019appel que la cons\u00e9quence de l’exercice du pouvoir de gestion de l’employeur de faire effectuer ou non ses heures venant en plus de l’horaire de travail normal.<\/p>\n

Dans un arr\u00eat du 6 janvier 2012, la Cour de cassation approuve la Cour d\u2019appel. Elle d\u00e9clare en effet que ne constitue pas une sanction disciplinaire le changement d’affectation d’un salari\u00e9 cons\u00e9cutif au retrait de son habilitation \u00e0 la conduite de certains v\u00e9hicules d\u00e8s lors qu’il a pour seul objet, conform\u00e9ment au r\u00e8glement de s\u00e9curit\u00e9 de l’exploitation d’un syst\u00e8me de transport public guid\u00e9, d’assurer la s\u00e9curit\u00e9 des usagers, du personnel d’exploitation et des tiers. Dans cette affaire, le retrait par la soci\u00e9t\u00e9 de l’habilitation du salari\u00e9 \u00e0 la conduite des tramways et son affectation sur une ligne d’autobus \u00e9taient intervenus apr\u00e8s que ce salari\u00e9, \u00e0 qui aucune r\u00e9primande n’avait \u00e9t\u00e9 adress\u00e9e en raison de cet incident, eut conduit une rame \u00e0 contresens de la circulation, et qu’il n’en \u00e9tait pas r\u00e9sult\u00e9 une modification de son contrat de travail mais seulement de ses conditions de travail.
