Y. a \u00e9t\u00e9 licenci\u00e9 pour faute grave pour avoir, \u00e0 la fin de sa journ\u00e9e de travail, particip\u00e9 \u00e0 un \u00ab\u00a0pot\u00a0\u00bb organis\u00e9 dans l’entreprise sans autorisation de l’employeur et consomm\u00e9 mod\u00e9r\u00e9ment des boissons alcoolis\u00e9es.<\/p>\n

Dans un arr\u00eat du 14 juin 2010, la cour d’appel de Metz avait d\u00e9j\u00e0 condamn\u00e9 l’employeur pour licenciement sans cause r\u00e9elle et s\u00e9rieuse.<\/p>\n

La Cour de cassation confirme la position des juges du fond.<\/p>\n

Dans un arr\u00eat du 15 d\u00e9cembre 2011, la Chambre sociale a consid\u00e9r\u00e9 que le fait reproch\u00e9 \u00e0 ce salari\u00e9 qui, en dix ann\u00e9es au service de l’employeur, n’avait fait l’objet d’aucune sanction, ne constituait pas une faute grave.<\/p>\n

Par contre, elle a d\u00e9j\u00e0 reconnu un licenciement pour faute grave valable lorsque le taux d’alcool\u00e9mie \u00e9tait sup\u00e9rieure au taux l\u00e9galement punissable et que le salari\u00e9 avait d\u00e9j\u00e0 fait l’objet de sanctions pour des faits similaires<\/p>\n","protected":false},"excerpt":{"rendered":"
