Un salari\u00e9 en contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e signe une promesse d’embauche pour un nouveau CDD pour la saison suivante, un autre salari\u00e9 de la soci\u00e9t\u00e9 n’\u00e9tant pas reconduit dans sa mission. Les salari\u00e9s \u00e9changent alors sur un r\u00e9seau social des propos relatifs au comportement de l’employeur, sur le \u00ab\u00a0mur\u00a0\u00bb du profil priv\u00e9 du salari\u00e9.<\/p>\n

Le salari\u00e9 en CDD d\u00e9clare:\u00a0\u00bb A toute la direction de C(…), vous \u00eates toutes de belles baltringues anti-professionnelles\u00a0\u00bb. Bien qu\u2019\u00e9tant sur le profil priv\u00e9 du salari\u00e9, les propos ont \u00e9t\u00e9 visibles de plus de 600 personnes.<\/p>\n

L’employeur en prend connaissance par un autre salari\u00e9 de l’entreprise. Consid\u00e9rant ces propos injurieux et mena\u00e7ants, il lui notifie un avertissement, et envoie par ailleurs un courrier lui indiquant que ces propos justifient le retrait de la promesse d’embauche du deuxi\u00e8me CDD.<\/p>\n

Le conseil de prud’hommes de Tourcoing donne raison \u00e0 l’employeur, au motif que le retrait par l’employeur de la promesse d’embauche est justifi\u00e9 \u00ab\u00a0du fait des injures et menaces prof\u00e9r\u00e9es par le salari\u00e9 sur le r\u00e9seau Facebook\u00a0\u00bb<\/em>.<\/p>\n

Dans un arr\u00eat du 16 d\u00e9cembre 2011, la Cour d’appel de Douai infirme le jugement. Elle retient que le salari\u00e9 \u00e9tant en CDD, son contrat ne peut donc \u00eatre rompu que pour faute grave ou force majeure (article L 1243-1 du Code du travail). Or tel n\u2019est pas le cas en l\u2019esp\u00e8ce. L’employeur ne s’est pas plac\u00e9 sur le terrain disciplinaire et les propos diffamatoires ou injurieux tenus par un salari\u00e9 \u00e0 l’encontre de l’employeur ne constituent pas un cas de force majeure.<\/p>\n

Comme la rupture du CDD \u00e9tait abusive, sans avoir \u00e0 aborder la question de savoir si des propos sur FACEBOOK devaient \u00eatre consid\u00e9r\u00e9s comme publics ou priv\u00e9s (et donc \u00e0 effectuer un quelconque revirement de jurisprudence), les juges d\u2019appel ont condamn\u00e9 l\u2019employeur.<\/p>\n","protected":false},"excerpt":{"rendered":"
