La Cour de cassation a consid\u00e9r\u00e9 dans un arr\u00eat du 17 novembre 2011que la lettre de licenciement devait indiquer les mots prononc\u00e9s par un salari\u00e9 susceptibles d’\u00eatre qualifi\u00e9s d’injures pour justifier de la faute grave du salari\u00e9.<\/p>\n

L’employeur est en effet tenu de rapporter la preuve des faits qui rendent impossible le maintien de l’int\u00e9ress\u00e9 dans l’entreprise et constituent une faute grave.<\/p>\n
