Dans ce cadre, il a \u00e9t\u00e9 jug\u00e9 \u00e0 plusieurs reprises que les gr\u00e9vistes ne commettent pas de faute lourde et donc ne peuvent \u00eatre licenci\u00e9s. Si, au contraire, L&rsquo;occupation emp\u00eache les non-gr\u00e9vistes de travailler, elle peut \u00eatre consid\u00e9r\u00e9e comme une faute lourde justifiant le licenciement des gr\u00e9vistes.<\/p>\n<\/div>\n<p style=\"text-align: justify\">La participation \u00e0 une gr\u00e8ve avec occupation jug\u00e9e illicite entra\u00eene une responsabi\u00adlit\u00e9 des salari\u00e9s individuellement. Chacun peut \u00eatre condamn\u00e9 \u00e0 des dommages-int\u00e9r\u00eats en faveur des non-gr\u00e9vistes pour la perte de salaire et en faveur de l&#8217;employeur pour le pr\u00e9judice subi du fait de cette occupation. Mais il faut prouver que tel gr\u00e9viste d\u00e9sign\u00e9 a bien particip\u00e9 \u00e0 l&rsquo;occupation, il ne saurait y avoir une res\u00adponsabilit\u00e9 collective.<\/p>\n<p style=\"text-align: justify\">Le gr\u00e9viste peut \u00e9galement \u00eatre condamn\u00e9 p\u00e9nalement pour entrave \u00e0 la libert\u00e9 du travail<i>.<\/i><\/p>\n<p style=\"text-align: justify\">Lorsque l&rsquo;occupation est jug\u00e9e illicite, le juge des r\u00e9f\u00e9r\u00e9s (qui statue en urgence) peut ordonner l&rsquo;\u00e9vacuation globale des gr\u00e9vistes par une ordonnance, lorsqu&rsquo;il y a atteinte au droit de propri\u00e9t\u00e9 ou \u00e0 la libert\u00e9 du travail.
