\nLe ch\u00f4mage du 1er<\/sup><\/b> mai<\/b><\/h2>\n

Le 1er mai doit \u00eatre un jour ch\u00f4m\u00e9, mais la loi pr\u00e9voit des exceptions pour les entreprises qui, en raison de la nature de leurs activit\u00e9s, ne peuvent interrompre leur fonctionnement.<\/p>\n

<\/h2>\n

Le paiement de la journ\u00e9e du 1er<\/sup><\/b> mai<\/b><\/h2>\n

La loi dispose qu’il ne doit y avoir aucune perte de salaire du fait du ch\u00f4mage du 1er mai. La paie ne doit donc pas \u00eatre modifi\u00e9e et il n’est pas n\u00e9cessaire de faire un d\u00e9compte sp\u00e9cial pour les salari\u00e9s pay\u00e9s \u00e0 l’heure ou au mois.<\/p>\n

Si le 1′ mai co\u00efncide avec un jour de repos (dimanche ou samedi non travaill\u00e9 habi\u00adtuellement), le salari\u00e9 ne peut pas pr\u00e9tendre au paiement de ce jour, car, dans ce cas, le ch\u00f4mage du 1er mai n’entra\u00eene pas de r\u00e9duction de son salaire.<\/p>\n

De m\u00eame, un salari\u00e9 qui aurait \u00e9t\u00e9 absent le 1er mai, si ce jour n’avait pas \u00e9t\u00e9 f\u00e9ri\u00e9 (pour cause de maladie, de gr\u00e8ve, de ch\u00f4mage partiel, par exemple) ne peut pr\u00e9ten\u00addre \u00e0 aucune indemnit\u00e9.<\/p>\n

En revanche, le salari\u00e9 dont l’absence justifi\u00e9e aurait pris fin la veille (le 30 avril) ou le lendemain (2 mai) peut pr\u00e9tendre au maintien de son salaire puisqu’il aurait effectivement travaill\u00e9 le 1′ mai, si ce jour n’avait pas \u00e9t\u00e9 f\u00e9ri\u00e9.<\/p>\n

La journ\u00e9e du 1er mai, bien que ch\u00f4m\u00e9e, est assimil\u00e9e \u00e0 une journ\u00e9e de travail effec\u00adtif pour le d\u00e9compte des heures suppl\u00e9mentaires de la semaine consid\u00e9r\u00e9e.<\/p>\n

Le travail exceptionnel le 1er mai<\/b><\/h2>\n

Dans les \u00e9tablissements o\u00f9 il est impossible de cesser le travail, l’employeur doit doubler le salaire du 1er mai.<\/p>\n

Le salari\u00e9 pay\u00e9 au mois devra percevoir 7\/151,67\u00e8me de son salaire en plus s’il travaille normalement 35 heures par semaine.<\/p>\n

Les sanctions<\/b><\/h2>\n
