Conditions de forme du CDD<\/h2>
Il existe des conditions obligatoires de forme du CDD pour qu'il puisse \u00eatre consid\u00e9r\u00e9 comme valable. En effet, le contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e doit obligatoirement \u00eatre r\u00e9dig\u00e9 par \u00e9crit et en fran\u00e7ais ainsi que comporter certaines mentions obligatoires.<\/div>

Un contrat \u00e9crit, condition de\u00a0forme du CDD<\/h3>\n

Le CDD doit respecter cette condition de forme<\/strong> essentielle qui est celle d’\u00eatre \u00e9crit. S’il n’est pas sign\u00e9 par les deux parties, il est par d\u00e9faut\u00a0un CDI.<\/p>\n

ATTENTION :<\/strong><\/p>\n

L’absence d’\u00e9crit comme non-respect d’une\u00a0condition de forme du CDD<\/em> ne peut \u00eatre invoqu\u00e9e que par le salari\u00e9 car elles sont \u00e9dict\u00e9es dans le\u00a0souci de le\u00a0prot\u00e9ger.<\/p>\n

Un contrat en fran\u00e7ais, condition de forme du CDD<\/h3>\n

Le CDD doit \u00eatre r\u00e9dig\u00e9 en fran\u00e7ais. Concernant cette condition de forme du CDD<\/strong>, c’est le lieu de conclusion qui pr\u00e9vaut.\u00a0Peu importe donc que le contrat soit ex\u00e9cut\u00e9 en France ou \u00e0 l’\u00e9tranger.<\/p>\n

A l’inverse, le contrat de travail sign\u00e9 \u00e0 l’\u00e9tranger pour s’ex\u00e9cuter totalement ou partiellement en France n’a pas \u00e0 respecter cette condition.<\/p>\n

Si certaines parties du contrat sont en langue \u00e9trang\u00e8re, l’employeur ne pourra pas\u00a0se pr\u00e9valoir de ces parties.<\/p>\n

Le salari\u00e9 peut demander \u00e0 b\u00e9n\u00e9ficier d’une version traduite dans sa langue du contrat de travail. S’il existe une version traduite du contrat de travail, seule la version fran\u00e7aise importe.<\/p>\n

Autre condition de forme du CDD, la pr\u00e9sence de mentions obligatoires<\/h3>\n

Le CDD doit enfin indiquer clairement l’objet pr\u00e9cis pour lequel il a \u00e9t\u00e9 conclu et certaines mentions obligatoires doivent obligatoirement y figurer:<\/p>\n

    \n
  • la d\u00e9signation du poste de travail ou de l’emploi concern\u00e9 ;<\/li>\n
  • la dur\u00e9e de la p\u00e9riode d’essai \u00e9ventuellement pr\u00e9vue ;<\/li>\n
  • la date d’\u00e9ch\u00e9ance du terme ou, si le contrat ne comporte pas de terme obligatoire, la dur\u00e9e de la p\u00e9riode minimale et, \u00e9ventuellement, une clause de report du terme ;<\/li>\n
  • dans le cas d’un remplacement, il convient d’indiquer le nom du salari\u00e9 remplac\u00e9 et sa qualification professionnelle ;<\/li>\n
  • l’intitul\u00e9 de la convention collective applicable ;<\/li>\n
  • le montant de la r\u00e9mun\u00e9ration, des primes et accessoires ;<\/li>\n
  • le nom et l’adresse de la caisse de retraite compl\u00e9mentaire, ainsi que ceux de l’organisme de pr\u00e9voyance. Doivent \u00eatre requalifi\u00e9s en contrats \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, les contrats :\n
      \n
    • non \u00e9crits ;<\/li>\n
    • non sign\u00e9s par le salari\u00e9 ;<\/li>\n
    • qui ne comportent pas l’une des mentions obligatoires pr\u00e9c\u00e9dentes.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

      ATTENTION :<\/strong><\/p>\n

      L’absence d’indication de la convention collective, qui fait pourtant partie des conditions de forme substantielles, n’entra\u00eene pas la requalification du contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e en contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e. On peut supposer qu’il en serait de m\u00eame en cas d’omission du nom et de l’adresse de la caisse de retraite compl\u00e9mentaire et de l’organisme de pr\u00e9voyance.<\/p>\n

      Le contrat de travail doit \u00eatre transmis au salari\u00e9 dans les deux jours suivant l’embauche.<\/p>\n<\/div>
