Rupture abusive de la p\u00e9riode d'essai<\/h2>
La rupture du contrat pendant la p\u00e9riode d'essai ne n\u00e9cessite pas de motivation de la part de l'employeur. Cependant, ce droit ne permet pas \u00e0 l'employeur d'op\u00e9rer une rupture abusive de la p\u00e9riode d'essai (l\u00e9g\u00e8ret\u00e9 bl\u00e2mable, rupture peu de temps seulement apr\u00e8s le d\u00e9but de la p\u00e9riode d'essai, d\u00e9tournement de la finalit\u00e9 de la p\u00e9riode d'essai).<\/div>

Si chaque partie au contrat est libre de rompre sans justifier\u00a0d’un quelconque motif au cours de la p\u00e9riode d’essai, cette rupture ne peut\u00a0\u00eatre pour autant fautive et constituer une rupture abusive de la p\u00e9riode d’essai<\/strong>.<\/p>\n

La rupture abusive du contrat de travail est alors r\u00e9par\u00e9e par l’attribution de dommages-int\u00e9r\u00eats.<\/p>\n

    La preuve de la rupture abusive de la p\u00e9riode d’essai<\/em> incombe au salari\u00e9. Elle est assimil\u00e9e \u00e0 un licenciement abusif.<\/p>\n

    L’intention de nuire ou la l\u00e9g\u00e8ret\u00e9 bl\u00e2mable justifiant la rupture abusive de la p\u00e9riode d’essai<\/h2>\n

    L\u2019intention de nuire est une attitude malveillante ayant pour but de causer un pr\u00e9judice \u00e0 autrui.*<\/p>\n

    La l\u00e9g\u00e8ret\u00e9 bl\u00e2mable consiste dans le fait de prendre une d\u00e9cision qui a des cons\u00e9quences n\u00e9fastes pour le salari\u00e9 du fait d’un manque de vigilance de l’employeur. On citera l’exemple de l’employeur qui d\u00e9cide de la rupture de la p\u00e9riode d’essai au moment o\u00f9 le salari\u00e9 vient de d\u00e9missionner de son emploi pr\u00e9c\u00e9dent.<\/p>\n

    A ainsi \u00e9t\u00e9 jug\u00e9e abusive la rupture du contrat d\u2019un salari\u00e9 de 45 ans, qui venait de d\u00e9missionner de son pr\u00e9c\u00e9dent emploi, cette rupture \u00e9tant intervenue alors qu\u2019il effectuait un stage d\u2019adaptation aux techniques de la soci\u00e9t\u00e9 et qu\u2019il n\u2019avait pas encore \u00e9t\u00e9 mis en mesure d\u2019exercer les fonctions qui lui avaient \u00e9t\u00e9 attribu\u00e9es.<\/p>\n

    De m\u00eame,\u00a0l’employeur, qui avait pr\u00e9text\u00e9 les absences d’un de ses salari\u00e9s ne pr\u00e9sentant pas de caract\u00e8re injustifi\u00e9\u00a0pour mettre fin \u00e0 la p\u00e9riode d’essai\u00a0est consid\u00e9r\u00e9 comme ayant\u00a0agi avec l\u00e9g\u00e8ret\u00e9 bl\u00e2mable.<\/p>\n

    Une rupture de la p\u00e9riode d’essai motiv\u00e9e par des divergences politiques aboutirait\u00a0\u00e9galement \u00e0 cette qualification.<\/p>\n

    Le d\u00e9tournement de la finalit\u00e9 de la p\u00e9riode d’essai rel\u00e8ve enfin\u00a0d’une rupture abusive de la p\u00e9riode d’essai.<\/p>\n

    Toute rupture de la p\u00e9riode d’essai qui se fonderait sur un motif\u00a0autre que la personne du salari\u00e9 sera consid\u00e9r\u00e9e comme abusive. Ainsi, seront consid\u00e9r\u00e9es comme abusives en raison de leur finalit\u00e9 la rupture de la p\u00e9riode d’essai :<\/p>\n

    • pour motif \u00e9conomique,<\/li>\n
    • servant en\u00a0r\u00e9alit\u00e9 \u00e0 pourvoir un poste provisoire,<\/li>\n
