La p\u00e9riode d\u2019essai permet \u00e0 l\u2019employeur d\u2019\u00e9valuer les comp\u00e9tences du salari\u00e9 dans son travail, notamment au regard de son exp\u00e9rience professionnelle et de ses comp\u00e9tences, et au salari\u00e9 d\u2019appr\u00e9cier si les fonctions occup\u00e9es et les t\u00e2ches \u00e0 r\u00e9aliser lui conviennent.<\/strong> <\/div>

La\u00a0p\u00e9riode d’essai\u00a0<\/strong>est une p\u00e9riode pr\u00e9vue au d\u00e9but d’un\u00a0contrat de travail, qui a la double fonction de permettre\u00a0\u00e0 l’employeur\u00a0de tester les aptitudes professionnelles du nouvel employ\u00e9\u00a0ou au salari\u00e9\u00a0de v\u00e9rifier\u00a0que la fonction\u00a0lui correspond.<\/p>\n

La p\u00e9riode d’essai, c’est quoi ?<\/h3>\n

L’embauche d\u00e9finitive d’un salari\u00e9 est pratiquement toujours pr\u00e9c\u00e9d\u00e9e par une p\u00e9riode d’essai<\/em> pendant laquelle l’employeur et le salari\u00e9 se gardent la possibilit\u00e9 de mettre un terme \u00e0 tout moment aux engagements pris sans r\u00e9paration \u00a0pour les cons\u00e9quences subies par l’autre. Cette p\u00e9riode accorde \u00e0 l’employeur d’\u00e9valuer la comp\u00e9tence professionnelle du salari\u00e9 et, \u00e0 ce dernier, de tester l’int\u00e9r\u00eat du poste et des activit\u00e9s qu’il exerce.<\/p>\n

Cependant, il est important de savoir qu’une p\u00e9riode d’essai n’est pas obligatoire et il faut\u00a0toujours qu’elle soit\u00a0mentionn\u00e9e au contrat de travail<\/strong>\u00a0ou dans la lettre d’engagement<\/strong> pour \u00eatre valable.<\/p>\n

Distinction avec\u00a0l’essai technique et le test\u00a0professionnel<\/h3>\n

Il ne faut pas m\u00e9langer p\u00e9riode d’essai<\/em>, essai technique<\/em> et\u00a0test\u00a0professionnel<\/em>.<\/p>\n

Le test\u00a0professionnel est une forme d’examen permettant \u00e0 l’employeur de contr\u00f4ler les comp\u00e9tences professionnelle et, au salari\u00e9, ses capacit\u00e9s pour la fonction \u00e0 pourvoir. Contrairement \u00e0\u00a0la p\u00e9riode d’essai qui fait partie du contrat de travail, le test professionnel pr\u00e9c\u00e8de l’embauche et constitue un proc\u00e9d\u00e9 de s\u00e9lection destin\u00e9 \u00e0 v\u00e9rifier les aptitudes techniques du candidat \u00e0 l’emploi envisag\u00e9.<\/p>\n

L’essai technique consiste en un travail, un genre d’\u00e9chantillon que le salari\u00e9 ex\u00e9cute quelquefois avant d’\u00eatre engag\u00e9. Son r\u00e9sultat conditionne l’embauche de l’employ\u00e9. Il n’est pas encadr\u00e9, sauf dans quelques conventions collectives et doit se d\u00e9rouler sur une assez br\u00e8ve p\u00e9riode. Il donne lieu parfois \u00e0 r\u00e9mun\u00e9ration ou \u00e0 remboursement de frais.<\/p>\n
