L’employeur est tenu de d\u00e9livrer un certificat de travail<\/strong> au salari\u00e9 lorsque celui-ci quitte l’entreprise, quel que soit son anciennet\u00e9, que l’embauche ait \u00e9t\u00e9 \u00e0 dur\u00e9e d\u00e9termin\u00e9e ou \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, et quelle que soit la raison du d\u00e9part (licenciement ou d\u00e9mission).<\/p>\n

Il en est ainsi m\u00eame lorsque le salari\u00e9 n’a travaill\u00e9 que quelques jours pendant la p\u00e9riode d’essai, ou lorsqu’il a quitt\u00e9 l’entreprise sans observer le pr\u00e9avis.<\/p>\n

Mais les tribunaux d\u00e9cident que le certificat de travail<\/em> est qu\u00e9rable et non portable. Cela signifie que c’est au salari\u00e9 de faire la d\u00e9marche pour l’obtenir et non \u00e0 l’employeur d’en prendre l’initiative. Et ils en tirent la cons\u00e9quence qu’en cas de contestation sur le point de savoir si le certificat de travail a \u00e9t\u00e9 remis ou non, c’est au salari\u00e9 de faire la preuve et non \u00e0 l’employeur.<\/p>\n
