Plan de formation<\/h2>
Le plan de formation est l'expression de la politique de formation de l'entreprise de l'entreprise regroupe l'ensemble des actions de formation financ\u00e9es par l'employeur et qu'il a d\u00e9cid\u00e9 apr\u00e8s consultation obligatoire du comit\u00e9 d'entreprise. Elle comprend l'ensemble des actions de formation que l'employeur pr\u00e9voit pour ses salari\u00e9s, en relation avec la strat\u00e9gie de d\u00e9veloppement de l'entreprise.<\/div>

L’\u00e9laboration du plan de formation<\/b>
\nL’employeur n’est l\u00e9galement pas tenu de mettre en place un plan de forma\u00adtion<\/strong>. Seules les tr\u00e8s petites entreprises comportant des emplois peu quali\u00adfi\u00e9s et non susceptibles d’\u00e9volution\u00a0font r\u00e9ellement\u00a0l’impasse du plan de formation.<\/p>\n

Des mesures\u00a0l’incitent\u00a0en effet\u00a0\u00e0 mettre en place un plan de formation<\/em> :<\/p>\n

    \n
  • les employeurs de 10 salari\u00e9s et plus peuvent utiliser une partie de leur participa\u00adtion au financement des actions men\u00e9es dans ce plan ;<\/li>\n
  • tous les employeurs sont tenus d’adapter leurs salari\u00e9s \u00e0 leur poste de travail.<\/li>\n<\/ul>\n<\/div>\n

    L’employeur\u00a0\u00e9labore son plan de formation en toute autonomie :<\/p>\n

      \n
    • fixe les actions de formation propos\u00e9es,<\/li>\n
    • choisir les salari\u00e9s\n
        \n
      • d\u00e9termine les modalit\u00e9s de leur r\u00e9alisation (en interne par le personnel d’encadrement ou aupr\u00e8s d’un prestataire, organisme priv\u00e9 ou public).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

        Les salari\u00e9s ayant deux ans d’anciennet\u00e9 b\u00e9n\u00e9ficient, \u00e0 leur demande, d’un \u00ab bilan d’\u00e9tape professionnelle \u00bb<\/em> avec leur employeur qui peut \u00eatre renouvel\u00e9 tous les cinq ans afin d’\u00e9laborer un projet professionnel et, le cas \u00e9ch\u00e9ant, de d\u00e9finir un projet de forma\u00adtion permettant de le mener \u00e0 bien.<\/p>\n

        Un entretien est \u00e9galement obligatoire \u00e0 45 ans dans les entreprises d’au moins 50 salari\u00e9s.<\/p>\n

        Proc\u00e9dure de mise en place du plan de formation<\/h2>\n

        Chaque ann\u00e9e, le comit\u00e9 d’entreprise doit \u00eatre consult\u00e9 au cours de deux r\u00e9unions (la premi\u00e8re avant le 1er octobre et la seconde avant le 31 d\u00e9cembre) sur le projet de plan de formation.<\/p>\n

        Dans les entreprises de moins de 50 salari\u00e9s, les d\u00e9l\u00e9gu\u00e9s du personnel exercent la mission du comit\u00e9 d’entreprise en mati\u00e8re de formation.<\/p>\n

        Pour les entreprises d’au moins 200 salari\u00e9s, une commission de formation doit \u00eatre constitu\u00e9e au sein du comit\u00e9 d’entreprise.<\/p>\n

        \n

        Le contenu du plan de formation<\/b><\/p>\n

        Le plan de formation peut comporter deux types d’actions.<\/p>\n

        Des actions d’adaptation au poste de travail ou li\u00e9es \u00e0 l’\u00e9volution ou au maintien dans l’emploi<\/b><\/h3>\n

        Celles-ci doivent se d\u00e9rouler pendant le temps de travail et donnent lieu au maintien de la r\u00e9mun\u00e9ration ant\u00e9rieure.<\/p>\n

        La formation peut toutefois entra\u00eener un d\u00e9passement de l’horaire de travail habi\u00adtuel. Dans ce cas, ce d\u00e9passement s’impute sur le contingent d’heures suppl\u00e9men\u00adtaires et donne droit \u00e0 la majoration de salaire et aux contreparties en repos pr\u00e9vues pour les heures suppl\u00e9mentaires.<\/p>\n

        Des actions ayant pour but le d\u00e9veloppement des comp\u00e9tences des salari\u00e9s<\/b><\/h3>\n

        Ces actions peuvent se d\u00e9rouler pendant le temps de travail mais \u00e9galement en tout ou partie hors du temps de travail dans une limite de 80 heures par an et par salari\u00e9 ou, pour les cadres au forfait en heures ou en jour dans la limite de 5 % de ce forfait.<\/p>\n

        Les heures de formation qui ont lieu pendant le temps de travail sont r\u00e9mun\u00e9r\u00e9es au taux normal. Celles r\u00e9alis\u00e9es en dehors du temps de travail donnent lieu au ver\u00adsement d’une allocation de formation d’un montant correspondant \u00e0 50 % de la r\u00e9mun\u00e9ration nette du salari\u00e9 concern\u00e9. Les accords de branche peuvent pr\u00e9voir une majoration de cette allocation d’au moins 10 % pour les salari\u00e9s qui engagent des frais suppl\u00e9mentaires de garde d’enfant afin de suivre une telle formation hors de leur temps de travail. Cette allocation n’est pas soumise \u00e0 la CSG, ni \u00e0 la CRDS.<\/p>\n
