Sanction disciplinaire<\/h2>
Constitue une sanction disciplinaire toute mesure, autre que les observations verbales prises par l'employeur \u00e0 la suite d'un agissement du salari\u00e9 consid\u00e9r\u00e9 par lui comme fautif, que cette mesure soit de nature \u00e0 affecter imm\u00e9diatement ou non la pr\u00e9sence du salari\u00e9 dans l'entreprise, sa fonction, sa carri\u00e8re ou sa r\u00e9mun\u00e9ration.<\/div>

La loi d\u00e9finit la sanction disciplinaire<\/strong> comme une mesure prise par l’employeur \u00e0 la suite d’un agissement du salari\u00e9 qu’il consid\u00e8re comme fautif et de nature \u00e0 affecter la pr\u00e9sence du salari\u00e9 dans l’entreprise, sa carri\u00e8re ou sa r\u00e9mun\u00e9\u00adration, de mani\u00e8re imm\u00e9diate ou non.<\/p>\n

Le principe de libre choix de la sanction disciplinaire\u00a0et ses limites<\/b><\/h2>\n

L’employeur est libre de fixer la sanction disciplinaire<\/em> qu’il consid\u00e8re ad\u00e9quate par rapport \u00e0 l’agissement fautif du salari\u00e9.\u00a0Cependant pour \u00e9viter les abus, la libert\u00e9 pour le chef d’entreprise de choisir la sanction disciplinaire \u00e0 appliquer \u00e0 une faute de discipline de la part d’un salari\u00e9 a fait l’objet de limitations par la loi ou par les tribunaux.\u00a0Les juges peuvent par exemple annuler une sanction \u00ab disproportionn\u00e9e \u00e0 la faute commise \u00bb <\/em>\u00e0 condition de justifier en quoi la faute est disproportionn\u00e9e.<\/p>\n
