Note de service<\/h2>
La note de service doivent respecter les dispositions relatives au r\u00e8glement int\u00e9rieur \u00e0 partir du moment o\u00f9 elles portent sur des prescriptions g\u00e9n\u00e9rales et permanentes dans les mati\u00e8res relevant du r\u00e8glement int\u00e9rieur<\/div>

Dans les entreprises de taille importante,\u00a0il n’est pas rare que\u00a0le chef d’entreprise passe par le biais\u00a0de la note de service<\/strong>, de la circulaire ou de la directive pour communiquer avec\u00a0les salari\u00e9s. Dans ce cas de figure, la question se pose de savoir si ces documents doivent\u00a0\u00eatre consid\u00e9r\u00e9s comme faisant partie du r\u00e8glement int\u00e9rieur et respecter les dispositions l\u00e9gales et conventionnelles qui y sont rattach\u00e9es.<\/p>\n

La position tant du Conseil d’Etat que de la Chambre sociale de la Cour de Cassation est\u00a0claire \u00e0 ce propos.<\/p>\n

Il est important de distinguer la\u00a0note de service ou tout autre document du m\u00eame type comportant des prescriptions g\u00e9n\u00e9rales et permanentes dans les mati\u00e8res relevant du r\u00e8glement int\u00e9rieur<\/em> de\u00a0la note de service\u00a0qui n’est qu’une\u00a0modalit\u00e9 d’application du m\u00eame r\u00e8glement<\/em>.<\/p>\n

La loi pr\u00e9cise en effet que \u00ab les notes de service ou tout autre document comportant des obligations g\u00e9n\u00e9rales et permanentes dans les mati\u00e8res mentionn\u00e9es dans le r\u00e8glement int\u00e9rieur sont, lorsqu’il existe, consid\u00e9r\u00e9es comme des adjonctions \u00e0 ce r\u00e8glement int\u00e9rieur : elles sont en toute hypoth\u00e8se soumises aux dispositions applicables au r\u00e8glement int\u00e9rieur \u00bb<\/em>.<\/p>\n

L’employeur ne peut donc passer par une\u00a0note de service pour\u00a0\u00e9tablir des r\u00e8gles g\u00e9n\u00e9rales et d\u00e9finitives\u00a0en mati\u00e8re de\u00a0discipline, d’hygi\u00e8ne ou de\u00a0s\u00e9curit\u00e9. Par contre, rien ne lui emp\u00eache de prendre par notes de services ou autres documents des mesures individuelles ou particuli\u00e8res, ou g\u00e9n\u00e9rales mais provisoires. Ainsi, en cas de contentieux, le juge fera une appr\u00e9ciation\u00a0concr\u00e8te de la situation en regardant par exemple si la note \u00e0 fait l’objet d’une distribution g\u00e9n\u00e9ralis\u00e9e \u00e0 l’ensemble des salari\u00e9s ou s’il ne visait que quelques salari\u00e9s.<\/p>\n

Quoi qu’il en soit, une\u00a0note de service ne peut permettre\u00a0de contourner les interdictions impos\u00e9es par le Code du Travail concernant le r\u00e8glement int\u00e9rieur.<\/p>\n

IMPORTANT :<\/strong><\/p>\n

En cas d’urgence, il est toujours possible pour l’employeur de\u00a0prendre des dispositions relatives \u00e0 l’hygi\u00e8ne et \u00e0 la s\u00e9curit\u00e9 de fa\u00e7on imm\u00e9diate, en en r\u00e9f\u00e9rant au CHSCT, au comit\u00e9 d’entreprise et \u00e0 l’inspecteur du tra\u00advail. Par contre, la situation devra \u00eatre r\u00e9gularis\u00e9e ult\u00e9rieurement soit par l’adjonction dans le r\u00e8glement int\u00e9rieur de ces dispositions, soit par la disparition pure et simple de ces dispositions.<\/p>\n<\/div>
