Lorsqu’un taux de salaire a \u00e9t\u00e9 convenu entre le salari\u00e9 et l’employeur, celui-ci est tenu de garantir le paiement du salaire<\/strong>.<\/p>\n

L’employeur ne peut pas, par exemple, sans l’accord du salari\u00e9 et sous pr\u00e9texte que celui-ci ne donne pas enti\u00e8rement satisfaction, lui verser un salaire inf\u00e9rieur \u00e0 celui qui avait \u00e9t\u00e9 pr\u00e9vu et qui figure sur la lettre d’engagement, <\/i>m\u00eame si ce salaire, une fois r\u00e9duit, demeure encore sup\u00e9rieur au SMIC ou au minimum garanti pr\u00e9vu par la convention collective pour la cat\u00e9gorie professionnelle de l’int\u00e9ress\u00e9. L’employeur est non seulement tenu de verser le salaire convenu, mais il doit encore accorder au salari\u00e9 les augmentations de salaire qui sont mentionn\u00e9es sur la lettre d’engagement (\u00e0 condition qu’elles ne r\u00e9sultent pas d’une clause d’\u00e9chelle mobile interdite par la loi).<\/p>\n<\/div>\n

Le salaire est la contrepartie de l’activit\u00e9 du salari\u00e9 au service de l’employeur. Celui-ci est donc tenu de lui fournir les moyens mat\u00e9riels (machine, outillage, local et la mati\u00e8re du travail). S’il ne le fait pas alors que le salari\u00e9 s’est tenu \u00e0 sa disposition dans les conditions pr\u00e9vues lors de son engagement, il devra payer l’int\u00e9gralit\u00e9 des salaires perdus pour les jours ch\u00f4m\u00e9s. Si l’employeur a modifi\u00e9 un jour l’horaire de travail en pr\u00e9vision d’une gr\u00e8ve de l’EDF, apr\u00e8s avis du comit\u00e9 d’entreprise, il ne pourrait cependant \u00eatre tenu \u00e0 indemniser les salari\u00e9s pour les heures perdues que s’il \u00e9tait revenu unilat\u00e9ralement sur son engagement de faire r\u00e9cup\u00e9rer les heures perdues.<\/p>\n","protected":false},"excerpt":{"rendered":"
